Data Processing Addendum

Effective 2 November 2026. Part of the Terms of Service for the ScaledApps services; applies when Customer Data includes personal data that ScaledApps processes for the customer.

1. Roles

The customer is the controller (or a processor acting for its own customer); Scaled Apps LLC is the processor, processing personal data only on the customer’s documented instructions — which are the Terms, this Addendum, and the customer’s use and configuration of the Services.

3. Our obligations

  • Process only on instructions; tell the customer if an instruction seems to break the law.
  • Confidentiality: staff with access are bound to confidentiality; access to customer content (e.g. a sendto message) by staff is logged.
  • Security (Annex A).
  • Help the customer answer data-subject requests (export and delete tools exist per Service; otherwise on request within 30 days).
  • Notify the customer of a personal-data breach without undue delay and within 72 hours of becoming aware, with what we know.
  • Delete or return Customer Data at the end of the Services (Terms 3.3).
  • Make available information needed to show compliance; audits by questionnaire, or on-site at the customer’s cost with 30 days’ notice.

4. Subprocessors

ScaledApps may use these subprocessors, and will give 30 days’ notice of a new one (by email to account owners), during which the customer may object and cancel:

The Services run on servers and devices operated by ScaledApps in the United States (including Raspberry Pi devices at several US sites that probe websites, receive mail and render thumbnails).

5. International transfers

Data is processed in the United States. For customers in the EEA, UK or Switzerland, the parties rely on the EU Standard Contractual Clauses (module 2, or module 3 where the customer is itself a processor) and the UK International Data Transfer Addendum, which are incorporated by reference.

Annex A — Security measures

  • Encryption in transit (TLS) everywhere; customer secrets (API key secrets, webhook signing secrets, sendto message content and subjects) encrypted at rest; API keys otherwise stored as hashes.
  • Sign-in to dashboards through ScaledApps ID; per-organization roles; staff access to administrative tools limited to named admins and logged.
  • Every change made by staff or through customer dashboards recorded in an audit log.
  • Customer webhooks and fetches only to public internet addresses (protection against reaching internal networks).
  • Devices at other sites sign every request and refuse private-network addresses.
  • Retention limits enforced automatically (section 2).
