These terms govern your use of the following services operated by Scaled Apps LLC, PO Box 17255, Salt Lake City, UT 84117-0255, United States (“ScaledApps”, “we”, “us”): offto.it, saveto.it, pingto.it, thumbto.it, authto.it, mapto.it and sendto.it (each a “Service”, together the “Services”). The Acceptable Use Policy and, where it applies, the Data Processing Addendum are part of these terms. Our general Terms of Use cover our websites and other products.
1.1 You use the Services through a ScaledApps account (id.scaledapps.com) and an organization in it. The organization is our customer; the people in it act for it with the roles it gives them (owner, admin, editor, viewer). You are responsible for who you add and what they do.
1.2 Each Service creates an account for your organization the first time a member signs in, on that Service’s free plan.
1.3 You must be at least 18 and able to agree to these terms for your organization.
2.1 Plans, prices and limits are those shown on each Service’s site and in your organization’s billing page at id.scaledapps.com. Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled.
2.2 You can change or cancel a plan at any time in the billing page. Upgrades take effect at once (prorated); cancellations at the end of the paid period. We do not refund partial periods, except where the law requires.
2.3 Prices exclude taxes; we add sales tax or VAT where we must collect it.
2.4 Limits. Each plan has limits (for example codes, documents, monitors, renders, phones, inboxes). Services allow a margin past some limits and then refuse new items until you are within your plan; they tell you on your account page and, where available, by email. We may suspend features (not data) of an account that does not pay.
2.5 We may change prices with at least 30 days’ notice by email; the change applies from your next renewal after the notice.
3.1 offto.it — printed codes keep working. Every short code you have made keeps redirecting on any plan, including after a plan lapses or is cancelled, for as long as offto.it operates. Editing and creating codes may be limited until you are within a plan.
3.2 For the other Services, your data is kept and stays available as described in each Service’s documentation; activity beyond the free plan (for example new checks, renders, monitors or messages) stops until you are within a plan again.
3.3 If you close your account, we delete your data within 90 days, except what we must keep by law or for billing records, and except the redirects of offto codes (3.1), which keep working.
4.1 You keep all rights to what you put into the Services (“Customer Data”). You give us the rights we need to run the Services for you: to store, process, copy and transmit Customer Data as the Services do.
4.2 Where Customer Data includes personal data of other people (the people who sign in to your site through authto.it, whose phones report to mapto.it, who email your sendto.it inboxes), you are the controller and we process it for you under the Data Processing Addendum.
4.3 Each Service keeps data for the periods stated in its documentation (for example, sendto.it message content 7 days; mapto.it raw locations 14 days). You can shorten some of them.
4.4 We do not sell Customer Data and do not use it to train models or for advertising.
You must follow the Acceptable Use Policy. We may suspend a Service, a key or an account that breaks it, without notice where needed to protect others, and will tell you why.
6.1 The Services are provided on a best-effort basis. We do not offer an uptime guarantee or service credits; any credits are at our discretion. Current status: status.scaledapps.com.
6.2 The Services depend on the public internet, on third-party systems (for example the sites you monitor or archive, email providers, mobile carriers) and on devices at more than one location. We are not responsible for those.
We improve the Services and may change or remove features. We will give at least 30 days’ notice by email before removing a feature your paid plan includes, and you may cancel for a prorated refund of prepaid fees for it.
We protect Customer Data with the measures described in the Data Processing Addendum. API keys, client secrets and signing secrets are shown once; keep them safe. You must tell us promptly of any unauthorized use of your account.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. In particular, we do not warrant that a monitor will detect every outage, that every document version will be captured, that every location will be reported, or that every message will be delivered.
10.1 NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA.
10.2 EACH PARTY’S TOTAL LIABILITY ARISING OUT OF THESE TERMS IS LIMITED TO THE FEES YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT. ON A FREE PLAN, THAT AMOUNT IS US$100.
10.3 These limits do not apply to your payment obligations, a party’s indemnity obligations, or liability that cannot be limited by law.
You will defend and indemnify ScaledApps against third-party claims arising from Customer Data or from your use of the Services in breach of these terms or the Acceptable Use Policy.
You may stop using the Services at any time. We may suspend or end an account for non-payment (after notice), for a serious or repeated breach of these terms, or where the law requires. On termination, section 3.3 applies.
These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. The state and federal courts located in Salt Lake County, Utah have exclusive jurisdiction, and both parties consent to them.
Changes to these terms are posted with a new effective date and emailed to account owners at least 30 days before they apply to paid plans. If a part is unenforceable, the rest stands. These terms, with the Acceptable Use Policy and the Data Processing Addendum, are the whole agreement for the Services. Notices to us: contact@scaledapps.com and the address below.
